Terms of Service

Effective October 20, 2026 · Automatic spam reporting and apps you connect added October 20, 2026 · Plans, free period and invites updated October 17, 2026 · Provider and recording disclosures updated October 5, 2026

These terms govern your use of Foyer. By creating an account or using the service, you agree to them. Please read them — a few sections carry real responsibility, especially around call recording, and Section 15 contains an arbitration agreement and class-action waiver (with a 30-day opt-out).

Foyer is operated by Engineering Pixels LLC, a Massachusetts limited liability company ("Foyer," "we," "us"). Contact: [email protected].

1. The service

Foyer answers phone calls that you forward to a Foyer number, screens each caller with an AI conversation, and routes the call according to your settings — connecting you, asking you for a live decision, taking a voicemail, or filtering it out. Foyer works by call forwarding during beta; we never take over, port, or replace your phone number.

By using Foyer you direct the assistant to answer and take part in these calls on your behalf, and you understand that every screened call is recorded and produces a written transcript of the assistant's conversation with the caller. Foyer's opening provides the recording notice before screening questions begin. Audio is stored only for voicemail and call types where you enable audio retention.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use Foyer. You may not use Foyer if U.S. sanctions or export-control laws prohibit us from providing the service to you.

3. Your account

You sign in using an available account sign-in method. You are responsible for activity under your account and for keeping your sign-in secure. You agree to provide accurate information.

4. Call forwarding & carrier charges

You are responsible for setting up call forwarding with your carrier and for any charges your carrier applies. Forwarding behavior varies by carrier; we provide setup guidance but cannot guarantee every carrier's forwarding works identically.

5. Call recording and transcription — your responsibility

The recording notice is mandatory. Every screening opening states that the call is recorded before screening questions begin. Custom openings are checked and automatically amended if the notice is missing. By default, audio files are kept for voicemails, calls held for your review, and suspected spam calls, and you can change which calls are recorded in Settings; real-time audio is always captured and processed to transcribe and conduct the call. Recording, interception, and transcription laws differ by jurisdiction, and some states require the consent of all parties to confidential communications. You are solely responsible for ensuring your use complies with all applicable laws where you and your callers are located, and you agree not to configure or use Foyer unlawfully.

6. Acceptable use

Foyer may place brief automated test calls to your forwarded lines, from Hi Foyer (209-HI-FOYER), to confirm call forwarding still works. These calls end within a few seconds and don't need to be answered.

6A. Automatic spam reporting

When Foyer turns a call away as spam, it automatically reports the calling number to Foyer's shared spam list. A report holds the caller's phone number (the full number is encrypted when stored), when the call came in and why Foyer treated it as spam. It never includes your name, your own phone number, the recording, the transcript or the call summary. Other members never see who reported a number.

When at least three different Foyer households have reported the same number, Foyer flags it, and calls from that number may be screened as spam or turned away for every Foyer member. Foyer may also include flagged numbers, with how many times they were reported but never who reported them, in complaints it files with regulators such as the FCC or FTC.

Automatic spam reporting is on by default. If your Foyer settings still show the auto-report switch, you can turn it off there.

If you think your number was flagged by mistake, email [email protected] and we will review it.

7. Free period, subscriptions & billing

7A. Invite to Foyer

Foyer may offer invite benefits under the separate Invite terms. A benefit is earned only after the stated eligibility conditions are met, as determined by Foyer; signing up alone does not earn one. An earned free month extends your free period or, if you already pay for a plan, may be provided in another form shown in the app, such as an app-store subscription offer. Using your own invite code, duplicate or fraudulent accounts, misleading promotion, paid review incentives, and attempts to manipulate attribution are prohibited. Invite benefits have no cash value, may expire, and may be capped, changed, or ended prospectively. When sharing an invite, you must clearly disclose that you may receive a Foyer benefit if the recipient joins.

7B. Health and professional use

Callers may volunteer appointment or other health-related details. Foyer is not a medical-record system, clinical service, or emergency service. Businesses that are HIPAA covered entities or business associates must not use Foyer for protected health information unless they have a written agreement with us that expressly permits that use. Consumer health disclosures appear in our Consumer Health Data Privacy Policy.

7C. Public-demo text messages

The current public phone demo does not offer or send post-call text messages. If Foyer later reintroduces an optional demo SMS, we will update these terms and provide the required disclosure and consent flow before sending it.

8. Your content & ours

As between you and Foyer, you retain the rights you have in content you provide to the service. Callers and other third parties retain their own rights in what they provide. You grant us the limited license we need to operate Foyer for you: to receive, store, process, transcribe, display, and back up call records and content, and to disclose them to the providers identified in our Privacy Policy for those purposes and to the apps you connect under Section 9A. The Foyer service, software, and brand belong to us; we grant you a personal, non-transferable right to use them while you have an account. If you send us feedback, we may use it without obligation.

9. Third-party services

Foyer uses service providers for communications, hosting, security, authentication, speech and AI processing, storage, email, notifications, app distribution, and payments. Their roles and data use are described in our Privacy Policy and service provider categories. We are not responsible for their outages or actions, and their terms may also apply to your use.

9A. Apps you connect

Where Foyer offers it on your account, you can connect your own AI assistant, app or script to Foyer, with a personal API key you create in Settings › Connected apps or by adding Foyer as a connector in an AI assistant such as Claude or ChatGPT. You choose and control a connected app; it is not run by Foyer and is not one of our service providers.

A connected app sees only what you allow when you connect it: your calls and summaries, screening conversations, transcripts and voicemail text, your contacts and settings, and call recordings only if you separately allow audio. If you allow changes and your plan includes them, it can make changes you could make in the app, such as changing your settings or how Foyer treats a caller. It cannot delete your account or buy a plan.

You decide where your Foyer data goes. Once a connected app receives it, that app's own terms and privacy policy govern what it does with the data, and we are not responsible for that app. Foyer doesn't sell this data or use it to train AI models. You can revoke a key or a connected app at any time in Settings › Connected apps; that stops new access but doesn't delete what the app already has. Foyer keeps a log of each app's activity.

Your callers' information, such as their phone number and what they said, may reach the apps you connect. You are responsible for using it lawfully, including the recording and consent rules in Section 5. The health and HIPAA limits in Section 7B still apply: don't use a connected app for protected health information unless you have a written agreement with us that expressly permits it.

10. AI screening — no guarantee; not for emergencies

Foyer's screening, summaries, suggested replies, and live relays are powered by AI and are not perfect. Foyer may misidentify a caller, misunderstand an instruction, relay an incorrect statement, let an unwanted call through, or screen a call you wanted. Review consequential details independently. Foyer is not an emergency service and must not be relied upon for emergency, medical, legal-deadline, or safety-critical communications. Always keep a direct means of reaching emergency services (911).

11. Disclaimer of warranties

Foyer is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that it will catch every unwanted call.

12. Limitation of liability

To the maximum extent permitted by law, Foyer and Engineering Pixels LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or missed calls. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow certain of these limitations; where that is the case, they apply to the fullest extent permitted.

13. Indemnification

You agree to indemnify and hold Foyer and Engineering Pixels LLC harmless from claims arising out of your use of the service, your violation of these terms, or your violation of any law or the rights of a third party (including recording-consent laws).

14. Termination

You may stop using Foyer and delete your account at any time. We may suspend or terminate accounts that violate these terms or that we reasonably believe pose a risk. On termination, your data is handled per our Privacy Policy.

15. Disputes: arbitration & class-action waiver

Please read this section carefully — it affects your rights. It requires most disputes to be resolved by binding individual arbitration rather than in court, and waives class actions and jury trials. You can opt out within 30 days (see below).

16. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws rules (except that the Federal Arbitration Act governs Section 15). Any dispute not subject to arbitration — other than small-claims cases — will be brought in the state or federal courts located in Massachusetts, and both of us consent to their jurisdiction. If you live in a state whose consumer-protection law gives you rights these terms cannot take away, you keep those rights.

17. Changes to these terms

We may update these terms; the "Effective" date reflects the latest version, and we will notify you of material changes through the app or by email. Continued use after changes means you accept them — except that if we materially change Section 15 (arbitration), you may reject that change by emailing us within 30 days of notice, and the prior version will continue to apply to you.
